1. Acceptance of Terms

By downloading, installing, or using VocaTrace ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not download, install, or use the App.

Age Requirement: You must be at least 13 years old to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent that you meet these age requirements.

2. Description of Service

VocaTrace is a language learning application that provides handwriting practice worksheets for Asian languages including Thai, Korean, Chinese, Japanese, and Vietnamese. The App offers both free and premium features.

Educational Content Disclaimer: The language content, vocabulary, and exercises in the App are provided for educational practice purposes only. Thuong Studio makes no representation that the App will make you fluent, enable you to pass any examination, or meet any particular educational standard. Results vary by individual.

3. User Accounts

The App does not require user accounts. All data is stored locally on your device. You are responsible for maintaining the security of your device and for all activity that occurs through your use of the App.

4. Purchases & Payments

Premium features are available through the following purchase options, all processed through Apple App Store or Google Play Store:

Monthly Subscription — Auto-renewable subscription billed every month.
Yearly Subscription — Auto-renewable subscription billed every year.
Lifetime Access — A one-time, non-recurring purchase that grants permanent access to all current premium features.

Auto-Renewal: Monthly and yearly subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Payment is charged to your Apple ID or Google Play account at purchase confirmation.

Cancellation: You may cancel a subscription at any time through your App Store or Google Play Account Settings. Cancellation takes effect at the end of the current billing period; you retain premium access until then.

Restore Purchases: You can restore any prior purchase on a new device using the same Apple ID or Google account.

Refunds: All purchases are processed by Apple or Google, and refund requests are subject to their respective refund policies. Thuong Studio has no ability to issue refunds directly. Refunds are not guaranteed except as required by applicable consumer protection law.

Lifetime Access Scope: "Lifetime Access" means access for as long as Thuong Studio continues to operate and maintain the App on your device's platform. It applies to all premium features available at the time of purchase. Future major feature expansions, add-on packs, or separate products may be sold separately. If the App is discontinued (see Section 17), Thuong Studio's obligation under Lifetime Access ends.

Offline Access: Premium status is verified online. If an internet connection is unavailable, access is maintained using a locally cached verification valid for up to 14 days. After 14 days offline, an internet connection is required to confirm active subscription or purchase status.

5. Free Trial

New users receive a 7-day free trial with full access to all premium features. No payment information is required during the trial period — the trial is managed entirely by the App and does not involve any store billing.

At the end of the trial period, access to premium features will be restricted unless you subscribe (monthly or yearly) or purchase Lifetime Access. You will not be charged automatically when the trial ends.

Subscribing during the trial: If you purchase a subscription or Lifetime Access while your free trial is still active, the trial ends immediately and billing begins at that point. You will be charged for the full subscription or purchase price right away and will not receive a pro-rated credit for remaining trial days.

6. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, audio, and software — are owned by or licensed to Thuong Studio (thuong.studio) and are protected by international copyright, trademark, patent, and other intellectual property laws. You may not use, reproduce, or distribute any part of the App without Thuong Studio's prior written consent.

7. License Grant and Restrictions

Thuong Studio grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, solely for your personal, non-commercial language learning purposes, subject to these Terms.

You may not:

Copy, modify, adapt, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Rent, lease, lend, sell, or sublicense the App or any part of it
Remove or alter any proprietary notices or labels
Use the App for any commercial purpose without Thuong Studio's prior written consent
Redistribute or resell any content from the App
Attempt to bypass, disable, or circumvent any security, access control, or digital rights management feature
Use the App for any unlawful purpose or in violation of any applicable laws or regulations

Termination of License: Your license terminates automatically if you breach any provision of these Terms. Upon termination, you must cease all use of the App and delete any copies in your possession.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR COURSE OF PERFORMANCE.

Thuong Studio does not warrant that:

The App will function uninterrupted, error-free, or securely at all times
Defects or errors will be corrected
The App or its servers are free of viruses or harmful components
The results of using the App will meet your requirements or expectations
The language content, translations, or educational material in the App is accurate, complete, or current

Third-party services: The App may rely on third-party services (Apple App Store, Google Play, device platform services). Thuong Studio is not responsible for the availability, accuracy, or actions of those services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THUONG STUDIO AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.

Aggregate Cap: In no event shall Thuong Studio's total cumulative liability, for all claims in aggregate arising from or relating to these Terms or the App, exceed the greater of: (a) the total amount you paid Thuong Studio in the twelve (12) months immediately preceding the claim, or (b) USD $10.

Some jurisdictions do not allow the exclusion or limitation of certain types of liability, so parts of the above may not apply to you. In such cases, liability is limited to the fullest extent permitted by applicable law.

10. Changes to Terms

Thuong Studio reserves the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this document and, where reasonably practicable, provide notice within the App. Your continued use of the App after the Effective Date of revised Terms constitutes your acceptance of those changes. If you do not agree to revised Terms, you must stop using the App.

11. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in the Privacy Policy, accessible from within the App (Settings → Privacy Policy).

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions.

EU / EEA Users: If you are a consumer located in the European Union or European Economic Area, nothing in these Terms limits or removes your rights under mandatory local consumer protection laws, including the EU Consumer Rights Directive.

Dispute Resolution: Before initiating any formal legal proceeding, you agree to first contact Thuong Studio at support@thuong.studio and attempt to resolve the dispute informally for at least 30 days. If the dispute is not resolved informally, it shall be submitted to the exclusive jurisdiction of the courts in Vietnam, except where prohibited by applicable local law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Thuong Studio and its owner from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the App; (b) your violation of these Terms; or (c) your violation of any third-party right, including any intellectual property, privacy, or consumer protection right.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Thuong Studio regarding the use of the App and supersede all prior and contemporaneous agreements, representations, and understandings, whether written or oral.

16. No Waiver

Thuong Studio's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any breach shall not be deemed a waiver of any subsequent breach.

17. App Discontinuation

Thuong Studio reserves the right to discontinue, modify, or withdraw the App, or any feature thereof, at any time with reasonable notice where practicable. If the App is permanently discontinued:

Active subscriptions will be cancelled and pro-rated refunds will be handled through Apple or Google in accordance with their policies.
Lifetime Access holders are entitled to continued use of the final available version of the App for as long as the underlying platform (iOS/Android version) supports it, but Thuong Studio is not obligated to provide further updates, maintenance, or support.
